How to Win Council Contracts as a Small Builder

The short answer

Small council jobs are usually let by invited quotes, not adverts, so get onto the council's supplier lists and portal, register on Find a Tender and make the right officers know you. Then price to win on quality as well as price.

  1. Councils buy by value band. Under the law, contracts of £30,000+ that a council advertises need a public notice. Below that, and often well above it, the council's own rules apply.
  2. Much small work is never advertised. One council's published rules, for example, use three invited quotes up to £99,999 and advertise from £100,000.
  3. So the first job is getting asked. Supplier lists, the council's e-tendering portal, Find a Tender and the officers who commission repairs and minor works.
  4. Councils must pay within 30 days. The same 30-day term applies to subcontracts under the council contract.

The short answer

Most small builders wait for a council tender to appear online. But a lot of small council work is never advertised. It goes to firms the council invites to quote.

So winning council work has two parts:

  1. Get asked. Supplier lists, the council's portal, Find a Tender, and the officers who commission the work.
  2. Win on the scoring. A clean pre-qualification pack, case studies that match the job, and a price built from the bottom up.

The law now gives small firms real help on the second part. The first part is down to you.

How councils buy building work, by value

Every council has contract procedure rules (sometimes called standing orders) that set how it buys at each value. The Procurement Act 2023 sits on top of them:

Contract value What the law says What usually happens
Under £30,000 No duty to advertise Quotes from firms the council picks, under its own rules
£30,000 and up If advertised, a notice must go on Find a Tender first. The council may instead invite only pre-selected suppliers Invited quotes, a framework call-off, or an open tender
Advertised works under £207,720 The council can't shortlist bidders on a suitability questionnaire Anyone can submit a tender; bids are then scored
Works over £5,193,000 Full Procurement Act procedures Large projects, usually through frameworks

A real example. Basingstoke and Deane Borough Council publishes its bands. It asks for one written quote under £5,000. From £5,000 to £99,999 it asks for three written quotes, not advertised. From £100,000 it uses a framework or open tender, advertised.

At that council, a £60,000 refurbishment can go to three firms it already knows. If you're not one of them, you never see it.

Mistake to avoid

Only watching tender portals. By the time small council work is advertised, the jobs you could win most easily have already gone to firms on the quote list.

Losing tenders usually starts before the bid. Take the free 4-minute Construction Business Scorecard: 18 questions on your pipeline, sales, pricing, cash flow and systems, with your weakest area shown first.

1Step 1 of 5

Step 1: get on the lists

Do all of these in your first month:

  • The council's own pages. Search "[council name] selling to the council" or "doing business with us". Note their portal, their rules and any events.
  • The council's e-tendering portal. Register, pick the right categories (building works, repairs, your trade) and switch alerts on.
  • Find a Tender. Register and share your core supplier information. Public buyers must confirm you've done this before you take part under the new rules.
  • Local supply chain schemes. Some councils run them. Hammersmith & Fulham, for example, offers local construction and property maintenance firms introductions to buyers, one-to-one advice and access to work from its framework contractors.
  • Neighbouring councils and housing associations. Each runs its own lists. Five councils near you means five chances to be asked.

Council housing, schools and offices need repairs and refurbishment every year. The firms that get asked to quote are the ones officers already know.

Step 2: make the right people know you

Quotes go to firms officers trust. Find the teams that commission your kind of work, such as housing repairs, property and facilities, or schools. Then:

  • Send a one-page introduction What you do, the value range you deliver, your area, accreditations and three photos of similar finished jobs.
  • Ask how they appoint for jobs under their tender threshold, and how to be considered.
  • Go to supplier events when the council runs them, and follow up the people you meet.
  • Deliver the first small job perfectly. On time, tidy site, clean paperwork. The second invitation comes from the first job.

3Step 3 of 5

Step 3: be tender-ready before they ask

When the invitation comes, you'll often have days, not weeks. Build the pack once:

  • Pre-qualification. The Common Assessment Standard, through one of seven recognised bodies such as Constructionline or Veriforce CHAS. (PAS 91, which older guides mention, was withdrawn in 2023.)
  • Insurance. Employer's liability of at least £5 million is a legal requirement if you employ people. Other levels are set in each tender.
  • Health and safety. Policy, risk assessment and method statement templates, training records. Our selection questionnaire guide goes through each section.
  • Case studies. Three to five jobs with photos, value, dates and a reference who answers the phone.

Craftex holds CHAS, SafeContractor and ISO 9001, 14001 and 45001. You don't need all of that for your first council job. Start with what the tenders you want actually ask for. Our tender guide has the full pack, and our CHAS guide shows the cost and timeline of the scheme councils ask for most.

I made this mistake myself. At Craftex I paid a lot for accreditations, and on their own they never paid off. Get an accreditation only when a specific tender for a specific project asks for that specific accreditation. Most schemes take 2–3 months, so you will have time once the request is real. Don't buy them hoping work will start pouring in. It won't.

4Step 4 of 5

Step 4: know the rules that protect you

The Procurement Act 2023 changed things in favour of small firms (the full list is in the Procurement Act 2023 for small construction contractors). Use these points when you read tender documents:

  • No suitability shortlisting on open small works. When a council advertises a below-threshold works contract under £207,720, it can't filter bidders out on a suitability questionnaire.
  • Proportionate conditions. On larger tenders, buyers can't ask for audited accounts you're not legally required to have, or for contract insurance to be in place before award.
  • Small firms count. Councils must have regard to the barriers small firms face and consider splitting work into lots.
  • 30-day payment. Council contracts carry a 30-day payment term from a valid invoice, and it applies to the subcontracts under them too.
  • Feedback you can use. On competitive tenders above the thresholds, every assessed bidder gets an assessment summary comparing their tender with the winner's.
5Step 5 of 5

Step 5: price and write to win

Councils award the most advantageous tender, not simply the cheapest. Quality, method and price are scored, and an abnormally low price can be rejected.

  • Price from the bottom up Labour, materials, prelims, overheads, then margin. Never "just to get in".
  • Answer the question that's scored, in the order it's scored, with photos and evidence from similar jobs.
  • Show how you'll work in an occupied building How you'll keep residents, pupils or staff safe and the building running.
  • Ask for feedback every time you lose, and use it on the next bid. See why contractors keep losing tenders for the questions to ask.

Not yet able to deliver a council contract alone? Subcontract to the council's framework contractors. Their award notices are on Find a Tender and Contracts Finder, and every package you deliver becomes a public sector case study. The next step after that is a framework of your own: see how to get on construction frameworks.

At Craftex we tender for our own projects every month. Our bid service watches Find a Tender, council, housing association and main contractor portals for clients. Marek & Piter, two clients we worked with, won a £450K tender in South Kensington. "The fee has already returned 5×." Individual results, not typical or guaranteed.

FAQ

Frequently asked questions

Do councils have to advertise contracts?

Not all of them. Under the Procurement Act 2023, a council that advertises a contract worth £30,000 or more must first publish a below-threshold tender notice, but it can instead invite tenders only from particular or pre-selected suppliers. Below £30,000 there is no legal duty to advertise, and each council follows its own contract procedure rules.

How do I get on a council's approved contractor list?

Find the council's procurement or 'selling to the council' page, register on its e-tendering portal and any supplier or local supply chain scheme it runs, and register on Find a Tender. Then introduce your firm, with case studies, to the teams that commission the work you do, such as housing repairs or property services.

Can a sole trader or small firm win council contracts?

Yes. Councils must have regard to the barriers small firms face, and when they advertise a below-threshold works contract under £207,720 they can't shortlist bidders on suitability. Start with minor works and repairs where your case studies match, or subcontract to the council's framework contractors.

What insurance do I need for council work?

If you employ people, employer's liability cover of at least £5 million is a legal requirement. Public liability and other levels are set by each council in the tender documents. Under the Procurement Act, a council can't require insurance for the contract to be in place before it awards the contract.

How quickly do councils pay contractors?

Within 30 days of receiving a valid invoice, or from the date payment falls due if later. That term is implied by the Procurement Act into council contracts, including below-threshold ones, and also into the subcontracts that deliver them.
